Is Europe regulating the future or forgetting to build it? The hidden flaw in digital sovereignty

As Europe builds on the GDPR and AI Act, the next frontier lies beyond rulebooks and penalties, writes Vendan Kumararajah, who argues that digital sovereignty will endure only if governance, legitimacy and distortion detection are engineered directly into the architecture of AI systems themselves, rather than imposed from outside through compliance alone

Europe has done more than any other region to regulate the digital economy. The General Data Protection Regulation set the global benchmark for privacy, while the AI Act now defines risk tiers for artificial intelligence. The Data Act and Digital Services Act, meanwhile, seeks to reshape digital markets. Europe’s next challenge now lies in achieving architectural coherence across its digital systems.

Digital sovereignty encompasses the governance structures that shape how digital systems operate and exercise authority. Hosting European data in European data centres and reducing reliance on foreign cloud providers form part of that landscape. Genuine digital sovereignty, however, requires legitimacy, distortion detection and continuous accountability to be embedded directly into the design of digital systems.

European digital policy today operates largely through compliance mechanisms, including risk classifications, documentation requirements, audit procedures and enforcement penalties. These are necessary but reactive tools, which only intervene after rules are broken. They do not continuously test whether systems remain ethically coherent as they evolve.

Artificial intelligence systems evolve over time. Incentives recalibrate, metrics invite manipulation, and governance bodies can settle into procedure. In the absence of structural mechanisms capable of identifying distortion at an early stage, sovereignty risks becoming declaratory rather than functional. An AI system that accumulates unseen distortion gradually forfeits the resilience required to exercise authority with durability and trust.

Europe must now confront a central policy question: who retains legitimate authority when digital systems act autonomously?

In public services, algorithmic systems already influence welfare allocation, border screening, healthcare triage, and policing. In the private sector, they shape credit scoring, recruitment, and market access.

Digital sovereignty requires the sustained justification of automated authority over time, ensuring that systems exercising decision-making power retain legitimacy as they evolve. That means continuous validation of decision-making legitimacy, active monitoring of systemic distortion, and recursive review of governance bodies themselves.

Sovereignty grounded in legitimacy sustains durable governance, anchoring the exercise of digital authority in structures that command continued public trust.

It is my view that Europe should now move from static oversight to embedded governance recursion. In practice, this would involve real-time governance dashboards for high-impact AI deployed in public administration, distortion-tracking mechanisms across data supply chains, particularly within cross-border AI training ecosystems, periodic authority renewal processes for systems exercising automated decision-making power, and ethical viability metrics integrated into procurement standards.

The objective is to redesign digital systems so that governance is structurally embedded within them, shaping how they function rather than operating as an external layer of supervision. Just as cybersecurity evolved from perimeter defence to zero-trust architecture, digital governance must undergo a similar transformation.

Europe enjoys a unique strategic position. The United States prioritises innovation scale, and China integrates state-directed digital infrastructure. Europe, historically, has prioritised institutional legitimacy and human dignity. If Europe embeds governance architecture directly into digital design, it could define a third path: high-innovation systems anchored in structural legitimacy. Such systems would not slow innovation, they would stabilise it.

Trustworthy architectures attract capital, partnerships and sustained adoption, while systems that accumulate fragility generate political pressure and regulatory escalation. The trajectory of the AI race will therefore be shaped by the capacity of digital systems to sustain public legitimacy under conditions of stress and scrutiny.

Taken together, these dynamics place Europe at an exciting and defining juncture. The regulatory scaffolding is in place, the language of sovereignty is embedded in policy discourse, and public demand for trustworthy digital systems continues to strengthen. What follows must therefore be architectural: a deliberate evolution from regulating digital systems to embedding governance within their design.

Conceived in structural terms — grounded in ethical coherence, distortion detection and the ongoing justification of authority — digital sovereignty would enable Europe to shape not only the rules of the digital age but its governing logic.

The measure of European digital power will lie in whether the systems built upon its data can sustain legitimate authority over time, which remains sovereignty’s most exacting test.
